Court rules restriction on movement at Pearl Garden Estate illegal – The Sun Nigeria

A The Lagos High Court, sitting in Epe, said the restriction of movement of property owners in the Pearl Garden Estate located in the village of Sangotedo in the Eti-Osa Local Government Area of ​​the State by CMB Building Maintenance and Investment Company Limited was illegal.

Judge Mufutau Olokoba made this statement when delivering his judgment in an action brought by some of the owners against CMB (property and property management agents) and Oyetubo Jokotade Estate Resource Limited (former landowners).

According to a certified copy of the judgment obtained by reporters in Lagos, the judgment was delivered on December 1, 2021.

The N100 million lawsuit was filed by the plaintiffs on February 9, 2015 following their dispute with the property developer.

It was filed by Messrs. Francis Adesuyi, Felix Obiakor, Martin Ajayi-Obe and Peter Afenotan as representatives on their behalf and on behalf of all interested owners within the Pearl Garden Estate.

In the judgment, the judge declared that the interference and violation of the plaintiffs’ rights by barricading and restricting the movement of plaintiffs and legal residents in and out of the estate by the defendants and their agents was unlawful. .

He held that the alleged inheritance charge of N35,000 bonus imposed by the second defendant on the claimants had been declared null and void.

The judge, however, refused to accede to the plaintiffs’ prayers to order the defendants to pay them N100 million as damages and that the defendants should bear the cost of the action.
